Google can't enforce German Microsoft injunction: ruling

SAN FRANCISCO (Reuters) - A U.S. appeals court ruled on Friday that Google's Motorola Mobility unit cannot enforce a patent injunction that it obtained against Microsoft Corp in Germany.

The injunction would bar Microsoft from "offering, marketing, using or importing or possessing" in Germany some products including the Xbox 360 and certain Windows software.

The ruling against the German injunction came from the 9th U.S. Circuit Court of Appeals in San Francisco.

Representatives for both companies could not immediately be reached for comment.

The current Xbox 360 is the market-leading console in the United States. Microsoft is expected to unveil its next generation Xbox video game console in 2013.

Microsoft has said that Motorola's patents are standard, essential parts of its software and that Motorola is asking far too much in royalties for their use.

Microsoft sued Motorola in the United States in 2010, and Motorola then filed a lawsuit in Germany. In April, a federal judge in Seattle granted Microsoft's request for a temporary restraining order against Motorola in Germany.

In its ruling on Friday, a three-judge 9th Circuit unanimously upheld the lower court order. Since Microsoft had already brought a lawsuit against Motorola for breach of contract in the United States, U.S. courts have the power to put the German injunction on hold, the 9th Circuit said.

"At bottom, this case is a private dispute under Washington state contract law between two U.S. corporations," the court ruled.

European regulators are investigating claims that Motorola over-charged Microsoft and Apple Inc for use of its patents in their products and thereby breached antitrust rules.

Novo Nordisk halts development of haemophilia drug

COPENHAGEN (Reuters) - Denmark's Novo Nordisk said on Friday it would discontinue development of its haemophilia drug treatment vatreptacog alfa.

The world's biggest insulin producer said in a statement the development would be discontinued after a few patients in a trial had developed anti-drug antibodies to the treatment, one patient with a potentially neutralising effect.

The drug was intended to replace some of the $1.43 billion annual sales of the company's only other haemophilia drug now on the market - NovoSeven - as it comes off patent.

NovoSeven sales peaked last year as the drug started to come off patent, and Novo Nordisk has said its sales would be flat this year.

The group has four haemophilia drug candidates in late stage three development after discontinuing vatreptacog alfa. It expects to file an application with U.S. and European authorities for haemophilia drug Turoctocog in the fourth quarter of this year.

The company's shares were down 0.2 pct at 1455 GMT, roughly in line with the Copenhagen stock exchange's benchmark index.

The iPhone app for Digg v1 has been updated to be a universal app for both iPhone and iPad. The iPad version offers the same version as the iPhone, just offers a more pleasant reading experience on the iPad's larger screen. Speaking of larger screens, this update does not include support for the iPhone 5's bigger display.

In addition to iPad support, Digg has added a "Reading Sync" feature that allows you to close the app in the middle of a store on one device and pick up where you left off on your other devices. You can also share articles via text and some of the UI elements have been simplified.

Have you used Digg for iPad, yet? The first thing I noticed is that scrolling through thumbnails of stories is a bit laggy. I'm snob when it comes to polished scrolling in apps, so this was enough for me to be turned off and close the app.

Oil giant's CEO: Risks of Arctic drilling too high

LONDON -- Energy companies should not drill for crude oil in Arctic waters because the environmental risks are too high, Total SA Chief Executive Officer Christophe de Margerie told the Financial Times?on Wednesday.

The newspaper, which operated behind a pay wall, described de Margerie's comments as the first time a major oil company has publicly criticized offshore exploration in the Arctic.

The risk of an oil spill in such an environmentally sensitive area was simply too high, according to de Margerie.

"Oil on Greenland would be a disaster. A leak would do too much damage to the image of the company," he said.

Earlier this month, Gazprom OAO delayed the start of oil production at its Prirazlomnoye field, the first Russian Arctic offshore oil deposit to be developed, due to safety concerns.

A report from the National Snow and Ice Data Center shows the Arctic's melting ice is resulting in the lowest sea ice levels since satellites started tracking the measurements in 1979. NBC's Brian Williams reports.

The Arctic is seen as a key source in the next decade for Russia, the world's largest oil producer.

Plans to drill for crude in the Arctic have raised concerns among environmental activists, who launched protests last month at the offshore platform that operates the Gazprom project.

Shell admits Arctic drilling defeat, for now

Earlier this month Royal Dutch Shell PLC had to abandon hope of drilling into oil reservoirs in the Chukchi Sea off Alaska after its containment dome was damaged during tests.

Environmentalists pointed to those setbacks as more evidence that offshore drilling in the Arctic is too risky.

Sen. Mark Begich, (D-AK), discusses what a delay in Arctic drilling means for the future of oil prices and exploration in the U.S.

"Letting Shell do top-hole drilling and other preparatory activities when they are clearly not ready to respond to an oil spill is like telling a drunk driver that as long as he stays off the freeway everything should be OK," said Rebecca Noblin, Alaska director of the Center for Biological Diversity, after Shell won approval to carry out additional preliminary drilling off Alaska -- this time in the Beaufort Sea.

The remoteness, the extreme cold and the threat from ice floes crushing equipment pile more costs on top of those imposed by restrictions on drilling during hunting and breeding seasons and requirements for expensive emergency equipment to be on standby.

And industry executives acknowledge that the economics of Arctic exploration is also shaky.

Nevertheless, Shell and other international oil and gas companies are moving into the Arctic because of increasing resource nationalism and dwindling production in their traditional heartlands of the Middle East, South America, the United States, the North Sea and elsewhere.

Persistently high oil prices are also making the huge engineering challenges of working in such a hostile environment look more worthwhile. In addition, the climate change that burning hydrocarbons contributes to has pushed back the ice, opening up access to, and markets for, the hydrocarbons there.

The prize of success could be huge. The International Energy Agency (IEA) estimates that some 30 percent of the world's undiscovered natural gas and 13 percent of its oil is waiting to be exploited in the Arctic.

Discovering the Louisville Loop [Family and parenting] | Louisville.com

Personal safety concerns have kept me from the completed portion of the Louisville Loop paved near my home for months. With its 100-mile span of discernible solitude, I imagine people lurking in the woods waiting for prey. I could never feel safe running the Loop alone, and at one time when I addressed public safety during an online Q&A with Mayor Fischer, I wasn't able to get a satisfying answer about what kinds of enforcement the Metro was planning, if any.

Occasionally, I see dog walkers or cyclists using the Loop as I drive by on my way to a metro park. At our parks, one can find populations of active people, or frightening (but enjoyable) seclusion surrounded by forest that always promises to loop back to the safety of my car, or to bring me by the patrol of an LMPD officer. But the Loop goes on and on, only promising more miles ahead.

On Saturday, at the end of a lazy afternoon, my family and I decided to explore the Loop. Feeling excited for adventure, but reasonably cautious, I slipped my $20 camping knife into my back pocket and handed my very lucky husband a pink canister of pepper spray.?

?

Hand in hand, we walked the winding path of the Loop together. The kids occasionally let go to chase butterflies and grasshoppers. We took photos that will become family treasures. We crossed the I Love Cameron bridge, and peered into the rocky Polar Pop Pit, a man-made hole filled with busted concrete and plastic soda cups from a nearby Circle K convenience store that are certain to defy the ages. It was quiet with the sounds of nature. The Loop was so tranquil that when I turned around to see a bike whizzing by within mere feet of me, I screamed. My husband laughed, "Didn't you see him coming?"

I really didn't.

?

After we covered a very slow single mile, my daughter wanted to continue on, demanding that we walk the entire Loop. I insisted we turn back, while her dad explained it would take us days and days [at her pace], and as I expected, when we arrived back to where we first began, her feet ached in her new black school shoes I bought that afternoon. We were homeward bound.

?

My fears of freaky solitude were unfounded when I was reassured by others enjoying the Loop, too: An elderly couple getting some exercise together; the man on his bike with his daughter, whizzing by. Nowhere to be found were the teenage users of the Polar Pop soda cups or whoever loves Cameron, but they probably stagger out of the woods around dusk.

If I can offer any advice about safety along the Loop's path, don't mess with the residents of cave-like holes the size of dinner plates dug into mounds of earth next to trees. Surely, something lives there.

?

For families who love our bountiful parks and preserved forests, the Loop offers even more natural experiences within the Metro, with transportation as a perk. You can use the Loop to go places, or you can simply turn around to get back to where you began once little feet get tired.

Samsung TouchWiz: Click with caution - News - Know Your Cell











If you're running Samsung's TouchWiz, take heed: The custom Android interface is vulnerable to a malicious bit of HTML that could wipe your entire device. And all it takes is the simple click of one dirty link.

There's no official word yet on exactly how many different devices could potentially be affected by it. But according to The Verge, so far it's been confirmed on both the Samsung Galaxy S2 and Galaxy S3 (it appears to only work on Samsung phones running TouchWiz).

The issue was brought to light last week during a security conference in Argentina, where researcher Ravi Borgaonkar explained how different codes can essentially send your Samsung phone back to factory reset. Check out the video below and stay tuned for an update.?

(AP) ? As condolences poured in from around the world, National Zoo officials waited Monday for word on why a 6-day-old panda cub died and lamented a heartbreaking setback to their closely watched breeding program.

The cub had liver abnormalities and fluid in its abdomen, but a cause of death will not be known until full necropsy results are available within two weeks.

The cub, believed to be female, died Sunday morning, less than a week after its birth surprised and delighted zoo officials and visitors. Zookeepers had all but given up on the panda mother's chances of conceiving after six years of failed attempts.

"Every loss is hard," National Zoo director Dennis Kelly said. "This one is especially devastating."

This much is known: The cub appeared to be in good condition. It had been drinking its mother's milk. And it wasn't accidentally crushed to death by its mother, which has happened to other panda cubs in captivity. At birth, the cubs are hairless, their eyes are closed and they're about the size of a stick of butter. Their mothers weigh about 1,000 times more.

Native to China, giant pandas have long been the face of the movement to preserve endangered species. A few thousand are believed to remain in the wild, and there are a few hundred in captivity.

Four American zoos have pandas, and several cubs have been born in the U.S., but the bears at the National Zoo are treated like royalty. The zoo was given its first set of pandas in 1972 as a gift from China to commemorate President Richard Nixon's historic visit to the country.

Thousands of people had watched an online video feed of the cub's mother, 14-year-old Mei Xiang, hoping to catch a glimpse of the newborn during its few days of life. Fans from around the country and the world shared their sympathy on social media sites, and many said they shared an emotional connection with the burly, black-and-white bear.

Since the cub's death, Mei Xiang has started eating and interacting with her keepers again. She slept Sunday night while cradling a plastic toy in an apparent show of maternal instinct, Kelly said.

Kelly Parsons of Alexandria, Va., who brought her two young sons to see the pandas Monday, said she felt for Mei Xiang.

"It sounds like the mom is in mourning. Whether you're a parent to an animal or a human being, it's just so sad, the loss of a child," she said.

Suzan Murray, the zoo's chief veterinarian, cautioned that while it may appear the panda is grieving as she cradles the toy, Mei Xiang is a wild animal and her thoughts and emotions are not well understood.

Mei Xiang's only cub, a male named Tai Shan, was born in 2005 and became the zoo's star attraction before he was returned to China in 2010. Since his birth, there had been five unsuccessful attempts to impregnate Mei Xiang, and zoo officials had considered swapping her and her male partner, Tian Tian, for another pair.

Zoo officials said they're focused on Mei Xiang's health but didn't rule out trying to breed her again. At 14, she may have a few more years of fertility remaining. The oldest panda known to have given birth in captivity was 19; pandas can live to their mid-30s.

The mortality rate for panda cubs in the wild is unknown, but in captivity, 26 percent of males and 20 percent of females die in their first year. The zoo's first panda couple, Ling Ling and Hsing Hsing, had five cubs during the 1980s, but none lived more than a few days.

The new cub's liver, about the size of a kidney bean, was harder than usual and discolored, Murray said. The fluid in the cub's abdomen was unusual and could have been a symptom of the liver problem, she said.

There was no evidence of fluid in the cub's lungs, which would suggest pneumonia.

Because Mei Xiang's other cub survived and she appeared to be taking good care of the newborn, zoo officials had been cautiously optimistic. Kelly said he was not aware of anything that could have been done to improve the cub's chances of survival.

The staff was taking the death especially hard because of the work they'd put in over the past six years to produce another cub, Kelly said. But even those who only watched Mei Xiang online were heartbroken.

"So sad watching her!" one Facebook commenter wrote. "She seems quite distressed and seems like she keeps looking for her baby. Can't figure out why they don't bring him/her back."

Each year on Yom Kippur, Jews wish each other a khatima tova (a good seal in the Book of Life) and tolerable fast. The route to a khatima tova is beyond the scope of this article; the route to an easy fast is simpler to describe. The following are the essentials of human physiology that will help you have a tolerable fast on Yom Kippur:

Don?t get thirsty:

Most people think the difficulty about fasting is feeling ?hungry?. However, avoiding thirst is much more important for how you feel. Not only do you avoid the discomfort of thirst but you are also well hydrated and swallow frequently, so your stomach does not feel as empty.

One important way to remain well hydrated is to avoid drinks or foods that cause your body to get rid of water. Such foods and drinks include alcohol, tea, caffeinated coffee and chocolate. Another important rule is to avoid consuming much salt. Salt causes a person to feel thirsty despite having a ?normal? amount of water, because extra water is needed for the extra salt. For this reason you should avoid processed foods containing lots of salt such as pickles, cold cuts, or cheese. Most tomato sauces, canned fish and smoked fish have a lot of added salt. Since Kosher meat has a high salt content it may be best to choose a main course such as fresh fish, canned no-salt tuna fish or a de-salted meat such as boiled chicken.

By avoiding these types of foods and drinks in the several hours before a fast, you can avoid either losing water or needing extra water. Other actions that cause the body to lose water, such as perspiring in warm clothing, should also be avoided during the fast.

Don?t start the pre-fast meal on a full stomach:

The pre-fast meal often begins at 5 PM, so a large lunch could prevent you from eating enough immediately before the fast. It is best to have a small lunch, or no lunch at all. A large breakfast early in the day based on cereals, breads and fruits can provide the energy you need during the day, yet these high-fiber foods will be far downstream by the time of the pre-fast meal and will not keep you from eating enough food at the pre-fast meal. A large breakfast is also helpful because it stretches the stomach. After eating breakfast, it is best to consume beverages during the day. This will not fill you up, since liquids are absorbed quickly, and this will ensure that you have absorbed enough fluids during the day to start the pre-fast meal being well hydrated. Be sure to avoid beverages with alcohol or caffeine. You should also drink at least a glass or two of fluids with the pre-fast meal because many foods need extra water to be digested properly.

Eat foods that are digested slowly:
Include some foods high in oils and fats in the pre-fast meal, since such foods delay emptying of the stomach and effectively prolong your meal. However, beware of fatty meats or salted potato chips that could load you up with too much salt. Salads and other high fiber foods that are so important in one?s normal diet should be de-emphasized for the pre-fast meal since they travel quickly through the digestive system. Fruit, despite its high fiber content, is worthwhile since it carries a lot of water in a ?time-release? form.

Don?t get a headache:
Withdrawing from caffeine produces a headache in people who drink several cups of coffee a day. If you consume this much caffeine in coffee or other foods or drinks you should prepare yourself for the caffeine-free period by reducing or eliminating caffeine from your diet in the days or weeks before Yom Kippur. Don?t try to get through the fast by drinking coffee right before Kol Nidre, since this will cause you to lose a lot of water.

Make the meal tasty enough so people will eat:

The pre-fast meal doesn?t have be bland. Spices such as lemon or herbs are fine for fasting, but salt and monosodium glutamate should be reduced as much as possible.

Don?t do a complete fast if you have certain medical problems:
People with medical conditions such as diabetes should consult their doctors and rabbis before fasting. Certain medications need to be taken during Yom Kippur, and it is important to swallow them with enough water to avoid pills getting stuck on the way to the stomach and damaging the esophagus. Fasting by women who are pregnant or breast feeding can also be dangerous. If a young person who has not fasted much before has unusual difficulty fasting you should discuss this with your doctor since this happens in some serious metabolic problems in which fasting can be very dangerous.

Don?t eat improperly after Neila:
Even people who have prepared well for fasting will be hungry after Neila. Be sure not to eat food too quickly at the post-fast meal. Begin the break-fast meal with several glasses of milk or juice: these put sugar into the bloodstream and occupy space in the stomach, discouraging you from eating too rapidly. Also be careful about eating high salt foods such as lox, since you will still be a little dehydrated and will need to drink a lot of fluids to avoid waking up extremely thirsty in the early morning hours. If you take vitamin C, be sure that you are fully re-hydrated beforehand, because one of the vitamin?s breakdown products can precipitate out in your urine if you are dehydrated, causing kidney stones, which are painful and dangerous.

These preparations for the fast of Yom Kippur will be different from your normal routine, but they can serve as a concrete reminder of the approaching Day of Atonement.

Center opens new era in organic synthesis, C-H functionalization

The National Science Foundation has awarded $20 million to Emory University's Center for Selective C-H Functionalization, which brings together scientists from leading research universities across the country working to revolutionize the field of organic synthesis.

"We believe that C-H functionalization will have a huge impact on the development of new drugs and other fine-chemical products, by breaking new ground for organic synthesis, and making it faster, simpler and greener," says Huw Davies, professor of chemistry at Emory and the director of the Center for Selective C-H Functionalization (CCHF).

Most of the synthetic products of modern daily life from our coffee cups and clothes to medications are derived from organic synthesis. Chemists start with simple, bulk chemicals that are readily accessible, like petroleum and plant extracts. These bulk materials are converted into commodity chemicals and then into finer chemicals through step-by-step transformations. These steps eventually lead to more elaborate structures like plastic, nylon and drugs.

"The center is at the forefront of a major paradigm shift in organic chemistry," Davies adds. "We're not just driving new methods of synthesis, we're building new models for teaching and research."

Traditionally, organic chemistry has focused on the division between reactive, or functional, molecular bonds and the inert, or non-functional bonds carbon-carbon (C-C) and carbon-hydrogen (C-H). The inert bonds provide a strong, stable scaffold for performing chemical synthesis on the reactive groups. C-H functionalization flips this model on its head.

"We are designing tools to make the scaffolding functional," Davies says. "We ignore the reactive groups and do synthesis at the inert C-H sites. We can now get reactions to occur at these sites."

Ultimately, the CCHF aims to open new chemical space for exploration. "It's like a farmer being able to grow crops in the desert, or in Antarctica," Davies explains. "C-H functionalization represents a whole new way for chemists to synthesize materials in what were once barren sites. It opens the possibility for materials that are completely different from anything we've known."

C-H functionalization is also more efficient, stripping out steps from the linear process of traditional organic synthesis, and reducing unwanted byproducts. "Every organic chemical has multiple C-H bonds, like the branching of a tree," Davies says. "That makes it possible to have convergence, a tremendously fast and powerful way to join two compounds together and build new molecules."

Emory competed with more than 50 other universities to win a $1.5 million NSF grant in 2009, which funded phase one of the CCHF. "The work of the center is right in the middle of my scientific passion," says Davies, whose lab developed a rhodium catalyst that can selectively activate C-H bonds.

In addition to the Davies lab, the Emory CCHF team includes chemists Simon Blakey and Cora MacBeth, and computer scientist Jamal Musaev, director of Emory's Cherry Emerson Center for Scientific Computation. World-class investigators of C-H activation from Stanford, the University of Illinois at Urbana-Champaign and the Scripps Research Institute round out the center's inaugural team.

"Organic chemistry tends to be incredibly competitive, with people mostly working in isolation," Davies says. "But we all recognized the grand challenge before us, and developed the trust needed to become an effective team."

The CCHF recently expanded to include a total of 25 scientists from 15 universities, representing the most comprehensive group of top experts in C-H functionalization ever assembled. The center has also forged alliances with companies in a range of industries, from pharmaceuticals to farming, that are eager to tap sustainable methods for the synthesis of fine chemicals. The collaboration has been prolific, resulting in 25 published papers so far.

"We are changing the field by working together," says Davies, who holds weekly video-conferencing sessions that unite the center's far-flung members. "We're pulling together the range of expertise needed to go beyond our individual research programs and develop broad applications of C-H functionalization."

Graduate students serve as liaisons, bridging labs and specialties. Felicia Fullilove, a PhD candidate in the Davies lab, is collaborating with a chemical engineer at the Scripps Research Institute, where she will spend some time this fall.

Most big science problems now require more of a team effort, so it's important to learn how to communicate across specialties."

Fullilove especially appreciated the chance to travel with a CCHF team to Washington DC, to help make the case for the $20 million grant to move the center into its second phase. "We had to make presentations and answer some tough questions before a panel," she says. "I learned a lot by seeing the inner workings of the grant process."

The CCHF is now poised to help C-H functionalization enter the mainstream of organic chemistry, Davies says. "We will keep building on the synergy and trust we've created," Davies says. "Collaboration will help us to make advances faster."

Many hurdles remain, he adds, before C-H functionalization can be fully optimized for broad applications. "Our goal is to make available a suite of chemical transformations for bond formation that are predictable, general and utilitarian," Davies says. "It's going to be an incredibly difficult thing to achieve completely, but even if we partially achieve it, that will be a huge advance for chemistry and for society. Today, more than ever, new products and materials need to be made efficiently, and in an environmentally sustainable way."

Center opens new era in organic synthesis, C-H functionalization

The National Science Foundation has awarded $20 million to Emory University's Center for Selective C-H Functionalization, which brings together scientists from leading research universities across the country working to revolutionize the field of organic synthesis.

"We believe that C-H functionalization will have a huge impact on the development of new drugs and other fine-chemical products, by breaking new ground for organic synthesis, and making it faster, simpler and greener," says Huw Davies, professor of chemistry at Emory and the director of the Center for Selective C-H Functionalization (CCHF).

Most of the synthetic products of modern daily life from our coffee cups and clothes to medications are derived from organic synthesis. Chemists start with simple, bulk chemicals that are readily accessible, like petroleum and plant extracts. These bulk materials are converted into commodity chemicals and then into finer chemicals through step-by-step transformations. These steps eventually lead to more elaborate structures like plastic, nylon and drugs.

"The center is at the forefront of a major paradigm shift in organic chemistry," Davies adds. "We're not just driving new methods of synthesis, we're building new models for teaching and research."

Traditionally, organic chemistry has focused on the division between reactive, or functional, molecular bonds and the inert, or non-functional bonds carbon-carbon (C-C) and carbon-hydrogen (C-H). The inert bonds provide a strong, stable scaffold for performing chemical synthesis on the reactive groups. C-H functionalization flips this model on its head.

"We are designing tools to make the scaffolding functional," Davies says. "We ignore the reactive groups and do synthesis at the inert C-H sites. We can now get reactions to occur at these sites."

Ultimately, the CCHF aims to open new chemical space for exploration. "It's like a farmer being able to grow crops in the desert, or in Antarctica," Davies explains. "C-H functionalization represents a whole new way for chemists to synthesize materials in what were once barren sites. It opens the possibility for materials that are completely different from anything we've known."

C-H functionalization is also more efficient, stripping out steps from the linear process of traditional organic synthesis, and reducing unwanted byproducts. "Every organic chemical has multiple C-H bonds, like the branching of a tree," Davies says. "That makes it possible to have convergence, a tremendously fast and powerful way to join two compounds together and build new molecules."

Emory competed with more than 50 other universities to win a $1.5 million NSF grant in 2009, which funded phase one of the CCHF. "The work of the center is right in the middle of my scientific passion," says Davies, whose lab developed a rhodium catalyst that can selectively activate C-H bonds.

In addition to the Davies lab, the Emory CCHF team includes chemists Simon Blakey and Cora MacBeth, and computer scientist Jamal Musaev, director of Emory's Cherry Emerson Center for Scientific Computation. World-class investigators of C-H activation from Stanford, the University of Illinois at Urbana-Champaign and the Scripps Research Institute round out the center's inaugural team.

"Organic chemistry tends to be incredibly competitive, with people mostly working in isolation," Davies says. "But we all recognized the grand challenge before us, and developed the trust needed to become an effective team."

The CCHF recently expanded to include a total of 25 scientists from 15 universities, representing the most comprehensive group of top experts in C-H functionalization ever assembled. The center has also forged alliances with companies in a range of industries, from pharmaceuticals to farming, that are eager to tap sustainable methods for the synthesis of fine chemicals. The collaboration has been prolific, resulting in 25 published papers so far.

"We are changing the field by working together," says Davies, who holds weekly video-conferencing sessions that unite the center's far-flung members. "We're pulling together the range of expertise needed to go beyond our individual research programs and develop broad applications of C-H functionalization."

Graduate students serve as liaisons, bridging labs and specialties. Felicia Fullilove, a PhD candidate in the Davies lab, is collaborating with a chemical engineer at the Scripps Research Institute, where she will spend some time this fall.
